Ebay shop being naughty

This might come as no suprise to many folk that use eblag but have just purchased an r/h xt rapid fire shifter for my bike build off i believe a well known bike dealer who also operate a ebay shop.... the description stated it was a genuine xt shifter in the box ,even showed a picture of the correct xt item....... so i bid on those facts,i won the auction at i must admit a relativly low ammount,but thats neither here nor there as far as im concerned as i chose to bid on what was purported to be for sale..... anyway the item turned up and is indeed a r/h shifter,but not branded as anything at all,no xt visible on it anywhere unlike the picture on the auction,box was a shimano item with the words xt grade shifter printed on the front....... i emailed the guy to clarify why it was not as shown and desribed in the auction,and he simply stated if not happy send it back..... i think this is naughty really,and im unwilling to leave negative feedback as he has history of trashing anybody who dares to do so....... now if he is sending out items which are not those that are being auctioned,is that fraud or not?......i paid within seconds of auction end as i always do,but if i leave him feedback saying goods are not as described he will ruin my feedback rating.... i just want what i won and paid for.....

  • You will always come across these jokers from time to time but it's not worth getting in a fluster over it. The old adage 'if it looks too good to be true........'.

    I use Ebay too, and I wouldn't worry about the feedback thing at all. People may check your history and so long as YOU don't get personal (just keep comments factual), they will see who is at fault. In any case, a high feedback score can absorb a negative easy enough. If it's a low figure, just sign up again with a different id! :-)

    You need to leave some constructive negative feedback. I know what you mean about not wanting to dent your ebay reputation but to be honest your feedback score is more important if you're selling rather than your buying. Even then most people look at the overall score not just individual pieces of feedback.

    It really p****s me off when sellers threaten you if you leave negative feedback. The whole point of the feedback system is to give us all a genuine idea of who you're dealing with. As a seller it's pretty easy to get good ratings, and the easiest way is to give an honest description of what you're selling. I've sold some right cr*p but I'm always honest about condition etc and have had some pretty good feedback to show people just want to know what they're buying.

    Give the feedback, if you do maybe a few others will and you can prevent some other poor git from getting stuffed.
    It's easier to ask for forgiveness than for permission.

    Give the feedback otherwise people will continue to make the same mistake you did :( Its not nice getting retaliation feedback but people will be able to see its not your fault as long as you are factual and not personal
  • Well ive sent a further mail asking for clarification on the matter,and the chances of me getting the actual article i paid for..... will leave it for a couple of days to see if i get any responce,wont be bidding on any more of his stuff thats for sure,glad it was only for a few quid,but thats not the point,would think there would be more hassle off indervidual sellers than from shops..... but there you go,live and learn i guess.

    A friend of mine had a similar experience, he won an auction for a graphics card XYZ and was sent an unbranded card... he was also afraid of leaving a negative feedback.... he found on internet a tip to deal with these scambags he waited 60 or 90 days, I don't remember exactly, just before midnight of the last day one can leave a feedback, he left a negative feedback :lol: - the scambag could only reply via email saying he would never do business with him again!!!!!

  • Well, I've just double checked some items I was watching on ebay, and sure enough there he was! Had a look through the feedback, and true enough, by percentage it's not bad. However the way he treats anyone who has had a problem is horrendous.

    I'm certainly not going anywhere near an auction with him involved, and that was a decision I made before I read all the linked posts from previous problems.

    As they said above, he might give poor feedback to you, but you have the chance to appeal to ebay if it's malicious. And it's quite clear that his replies are malicious, very few have anything to do with the complaint in the first place.

    This Dave Hinde / Number1Bikebits guy must be stopped. In my view the feedback he leaves people is libellous (says things like "theiving scum" and worse), he obviously repeatedly sells items that are not as described, he fails to deliver often, then blames the buyer, the list goes on! His % feedback score would be much worse if buyers were not intimidated. Add to this he has had an ASA adjudication against him for advertising (in magazines) items that he does not have in stock.

    Ebay should really take action, but one buyer (the one named "theiving scum") complained to ebay but they refused to remove the feedback. In my view, ebay is the publisher of a libel and should be called to account.

    Amazingly, eBay feedback policy states "Inflammatory language, such as "fraud, liar, cheater, scam artist, con man" etc, while discouraged, will not be removed."!!!!

    and feedback will only be removed if "...eBay is provided with a valid court order finding that the disputed Feedback is slanderous, libellous, defamatory or otherwise illegal. Claims of defamation submitted by solicitor do not constitute valid court orders. While such a claim will result in Feedback comment removal, the rating will not be removed without a court order.

    (they are very cavalier in this respect, whilst not the originator of a libel, those publishing it are culpable. Ebay need a test case to get their fingers burned).

    Surely this guy cannot continue to get away with it - we must do something! (what...?).

    Ebay obviously couldn't care less it would appear.

    People should complain about this guy - he should be forced out, and he would be if everyone boycotted that sh it and what he claims to sell.

    I agree that something should be done to stop this guy treating people in that way or at least teach him a lesson. The problem is that eBay would not do anything. A few years ago I had a dispute with eBay and in the end I gave up cause it was like talking to a brick wall :evil:

    Under Dispute Console there is an option for "Item not received or not as described process"

    I used this option successfully once before, I was asked by eBay to submit photos of the item.

    Somebody needs to sue Ebay - they might pay attention then. From what I can see the guy who had the defamatory feedback left has a very good case against Ebay as the publisher.
  • Ebay won't do anything about number1bikesh*ts because they generate too much revenue for ebay.
    Ebay won't do ANYTHING other than quote their rule-book and help-pages to you if you complain about a user.
    Ebay are happy to sit on the fence and rake it in.
    Ebay is a great idea but, like all walks of life, you will inevitably find a proportion of low-life pond creatures there.

    I, too, am an honorary member of the "screwed by Dave Hinde" club but, unlike most, I never received ANY communication from them other than an unpaid item dispute. It seems they either do not respond to your emails or respond with abuse, I guess I was lucky!

    As for the ebay feedback system, it is almost pointless as everybody wants to hang on to their "100% positive" rating so are reluctant to give out negative where deserved because you will undoubtably find that the idiots who deserve negative feedback will themselves give it simply in retaliation and not because it is deserved.

    So I take the "100%" rating with a pinch of salt, you'll find out more about someone by their response to a negative than all the positives they've got.

    If you are not satisfied with ebay's response to your complaint you can always file a claim via HMCS (Her Majesty's Courts Service) Online at http://www.moneyclaim.gov.uk.
    To quote their homepage: "Money Claim Online is a simple, convenient and secure way of making or responding to a money claim on the internet."
    This includes disputes such as those found on ebay but make sure you have all the evidence you would need to prove your case.

    Meanwhile, stay away from number1bikesh*ts, there are plenty of reputable bike dealers around.
  • All good points........ ive prchased loads of stuff on ebay these last couple of weeks,some from private sellers and a couple from shops who also trade on there,99% have been an absolute breeze,perfect in every way........ except the one bad egg,shame really but its behind me now,onwards and upwards as they say.
