Where do I stand?

Bad road, wheel stuck in rut unable to recover - bike flipped - I have broken collar bone and wrecked helmet (luckily not head). Where i crashed is horrific condition roadwise and i would need to be near central white line to clear. Am i in a position to sue county council for poor maint of roads??

Sorry for poor post, i am not used to typing with left hand!!

    Sorry to hear about your accident.

    Before you can be advised sensibly regarding any possible claim, much more information is needed. For example how long was road like that and had it been reported to the relevant highway authority.

    I would suggest you get yourself or someone down to the location of the accident ASAP and get photos of the location and measurements of the defect etc.

    You really need to get proper legal advice from a specialist firm of accident lawyers. Most will deal with case on a no win no fee basis.

    or another specialist firm.

    Do not confuse solicitors with claims management firms. Do not use a claims management firm.

    Thanks for the advice. Had a drive by today, it has white spray marks on so poss already reported. Will get pix tomorrow.

    That sounds helpful. Make sure to get measurement of size , depth etc of defects

    To add to Spen666's advice, please make sure the photos do not just show the defect, but also show exactly where it is in relation to its surrounding area.

    I encounter too many instances of 'nice' defect photos but the defects could be anywhere.
    There's no such thing as too old.

    I made the mistake of phoning the council when I ruined a car wheel in a pothole, asking if could claim. I told them where the pothole was. Curiously, the next day, it had gone. "What pothole?" So yes, photographs, with something for scale, asap.
