Sprung loaded rear end-without shock?

Nearly a year ago I had a problem with my rear shock (or so I thought) of a harsh top out going along. The bike went in for a service and came back fixed, great! So I didn't expect it to return. What happens is when I am pushing and even riding my bike now the shock harshly tops out.

Six months ago I took the shock off to change the spring and as expected the rear linkage with no support just collapses on itself.

Today however, after removing the shock once again, i notice that the rear linkage doesn't sink to it's lowest point. I thought it was caught on something but eventually realised it is actually sprung loaded for some reason or other. Is this supposed to be the case ? If so I can't believe that it was done, just so the frame holds itself up whilst the shock is removed and yet compromises the shock's life!

    sounds like the rear end is bent.

    it should move freely through it travel.
