I've just replaced my headset and found that the top headset bolt is pulling the star fangled nut up and not fully tightening. Is it necessary to have this bolt fully tightened or is it merely there to creat a seal??

sounds like you have the wrong star nut for your steerer.
the job of the bolt is to allow you to preload the headset bearings. there is no need to tighten it that much.
