Rear Wheel problem

I was standing infront of my Stumpjumper hardtail holding it up straight checking that the seat was straight after altering it, then i noticed that the front of my rear wheel nearest the seatpost wasnt inline with the rest of the frame and was sitting more to the right of the seatpost rather than inline with it.
I have undone the quick release checked that the wheel is sitting properly in the dropouts and it is, the bike was only bought new last monday and has only been used once on one of the local cycle tracks due to work and waiting for a new baby to arrive so it cant be due to abuse. Does abyone know what is causing this as i dont want to be fobbed off with something like, that is the way the bike is or some other bullsh!t when i take it back one day in the week for it o be looked at.

    There are a number things that could cause this issue:

    1. Skewed frame ---> install a known good wheel (without tyre) and double-check. If it is not the frame then it must be the wheel.

    2. If it is a dodgy rear wheel:

    a) check that the tyre is correctly mounted onto the rim.

    b) check that the axle is correctly spaced ---> clamp the wheel into the dropouts and measure the distance between the dropouts (it should be 135mm).

    c) If the axle is correctly spaced then check to see if the washers and bolts on either side are identical in thickness, if not, then swap them around to see if that helps.

    d) If they are identical and the axle is correctly spaced, then it must be a dish problem ---> send the wheel back to be re-dished towards the drive side.

    Hopefully it isnt a dicky frame, well i hope not seeing as its a new bike.
    If it the wheel that just needs redishing is it a case of the spoke needing tightening?

    Forgot to mention that the wheel stays in this postion even when it is spun.

    1 week old not your problem , send it back!

    It sounds like it needs dishing.

    Well i poped into the shop on hte way home from work to explain the problem and the fella said pop it in and they will have a look., cant say fairer than that. BUT he said if it is the frame they will have to send it off to the manufactuerer if that is the case am i entitled to a complete new bike rather than a frame swap, or if they cant source another bike a refund? .
    I really am hoping its just the wheel as i like the bike but just cheesed off that it hasnt had any real use as to what it is built for.
