new in january 2009 - done very little work and seem to perform as per normal - except when turning lockout lever on fork it has no effect. floodgate is wound to maximum and have tried working forks through full travel several times. any ideas?would this be covered under warranty?

Sounds like a seal has failed in the righthand leg allowing the damping circuit oil to leak into the lowers. You can test for this by letting all the air out of the positive chamber. The forks should compress and virtually all the stanchion should disappear. First time it happened to me with my REBAs I still had about 40mm of exposed stanchion, second time I caught it earlier and had about 25mm exposed.

If you remove the lowers you should find a lot of oil in the bottom.

It could also be the damping cartridge failing but I'd look at the oil seal failure first.

Second time it happened I stripped the forks myself and refilled with oil, have been OK for the last month. I meant to change all the seal as well but bought the wrong seal kit  Will buy the correct seal kit later in the year and replace everything.
It's easier to ask for forgiveness than for permission.

    I've bought a new bike....ouch - result
    Can I buy a new bike?...No - no result

Certainly should be, I personally wouldn't be self repairing forks under 12 months old.
