E13 and tyre clearance..

So when I was out yesterday, my big chunky tyres (which were fecking amazing over wet roots and terrible muddy terrain btw) kept rubbing on the lower chain guide on my E13.
It only happened when I was climbing + standing up as I tend to lean side to side with my pedal strokes.
I think its due to my bike having a fairly short chainstay, my mate has the same guide but loads more clearance.... my bike is suitable for 2.5" tyres. these are 2.3" but with big knobs... the other 2.35" tyres (small knobs + less grip) didn't rub.
Can't see it very well on the pics, but I have around 2-3mm clearance between the backplate and tyre when the bike is stationary.
Options.
1) leave it - surely this would make one side of the tyre wear more? + it pisses me off
2) file some of the E13 to allow more clearance - not really doable as it seems to catch right next to the grub screws that hold the chain guide on... its the backplate thats rubbing though so filing won't work anyways.
3) move the E13 on the ICSG tabs round a bit. therefore lowering the position of the chain guide. - i've just had a look and the effect will be very minimal so I doubt this'll work.
Anyone got any ideas?

Had to organise my toolbox (the one with spanners and screwdrivers in, cheeky!) today, as it was doing my head in!
As for your problem, you tried adding a washer at a time, untill it's far enough away from the tyre to not rub, but still inline with your chainring..?Boo-yah mofo

nope.... I know I have OCD
even got the cotton buds out as there was some mud I couldn't reach hehe.
managed to find a thinner spacer than the ones provided and have changed the position of the E13. it rubs a bit more on the upper chain guide, but I think tyre clearance is sorted0 -

If you don't know where the one little washer came from, and it's not obvious, it's probably fairly safe without it.

yea I thought about the BB spacers as i've got a spare few. Just thought i'd best leave them how they supposed to be.
Seems alright for now though, much more clearance compared to what there was before.
got around 10-12mm space between the knobs and mounting plate. Unless both the tyre and rim manage to flex a silly amount, I can't see there bein any rubbing.
I can put up with a bit of chain rub on the top chain guide0
