Drunken idiot (Not in a funny way)

Last night my girlfriend was driving home when this stupid drunk guy on a mountain bike rode straight across her path giving her no chance to avoid him, the retard then started getting aggressive towards her so the Police came, they breathalysed him and he blew 49mg (if thats right measurement) so they said he could be done for being drunk in charge of a pedal bike.

Anyone heard of this before? What kind of thing would happen to him?

She was pretty shaken up by it as you can imagine, he appeared from the side of a building which she had no chance of seeing round and she wasnt driving fast, Police taking no action against her as they put it down to "one of those things that happens"

    Any damage to the car? Did they get his details if so?

    If no damaged occurred I doubt you'll hear any more about it. It is crap, but there you are.

    They shouldn't have breathalised him. Such a measure is meaningless with respect to cycling, an activity which has no legal limit of alcohol. It's purely down to the judgement of the officers whether someone is too drunk to ride a bike.

    Unfortunately many police officers seem pretty ignorant of the law generally these days.

    I should think they kept him in the cells overnight and then let him go - unless they could find something else to charge him with.

    No damage to her car apart from cracked number plate, Police took his details and cos he was drunk and aggressive told my girlfriend not to give any of her details to him, if he wanted to get anything he would have to ask them for her details.

    Is just really annoying, he will no doubt change his story when he speaks to one of these no blame companies so he looks totally innocent!

    I really don;t think you have anything to worry about - just make sure you keep a record of everything that happened.

    Do you have the names/ numbers of the officers who attended?

    Apparently this officer told her the legislation is different for cyclists than other road users/modes of transport but he thinks he could still do him for something.

    Personally ive never heard of it before other than someone just getting a telling off but not actually done for it

    If the police have his details and have it on report that he was intoxicated, I doubt weather even the no-claim companies would touch him.

    I'm no expert though, hope she's ok now, that's the main thing, could always be worse eh.

    Yep she has all the details, she rang her insurers who have said they will file it away as they dont think anything will come of it but at least they have a record now incase he does try anything

    A friend of mine was once held in the cells overnight after being breathalised while riding a bike. He had no idea what the law said - but then he was French so had an excuse.

    To be honest most drunken cyclists are more of a danger to themselves than others.

    Yeah she is fine, she was very shaken up by it but she had no option other than to get back in the car and drive home once was all sorted which i think has done her good, she said she could easily have left car where it was and walked home.

    Sorry for rant just had to get it off my chest

    Glad to hear she's okay, there really are some idiots out there!
    I imagine the police took the breathalyser sample just so they had a formal record that he was 'drunk', rather than because of they thought there was a formal limit on alcohol consumption while riding a bike.
