Who pays return shipping, buyer or seller?

Bought a nice Prophet to enjoy in my new home and it arrived scratched to high hell, shock was knackered and front brake doesn't work. All damage was likely caused during transit due to the attrocious packaging job the seller did. He hasn't contacted me back about paying for the repairs so I'll just return it to the 'curse' who can then try to sell it for a fraction of the price I paid for it.
Bought on ebay, paid via Paypal. But who pays for the return shipping fee? Me or him? I've routed through some of Ebays help pages but it doesn't always do what it says on the tin... I'm of the impression he should pay - but then I am a bias party.

    Most companies ask that you pay for returns, dunno if it's the same for EvilBay though

    You could argue that you didnt pay postage for that item.
    You paid postage for a item that wasnt damaged so you havent recived the correct item. as you paid for a undamged one. And you want a undamaged one sending back.
    If it goes into a paypal dispute u gotta pay the postage im afraid

    bugger, so as far as Paypal are concerned, returning it is my business not the sellers... I can see this becoming a long drawn out farce. I don't really fancy sending it back and having to pay postage on another bike as i'll have paid $100 three times by then.

    so who's more knackered from all this, me or the bike?
  • If you want your money back, which I guess you do, you'll have to go through paypal within 60 days (Might be less now), that way, whatever the outcome your alot more likely to get your money back.
    As for postage, depending on the argument you put forward, and paypals decision, you may get a full or partial refund of postage on top of the price you paid for the bike..
    You do have some argument about the packaging, but your biggest argument would fall under "Item significantly not as described"
    Describe the damage to paypal, elborate, give reasons why your so angry and how this has affected things like a trip to work or something...
  • surely if the bike was sent via a courier firm then it will be insured against damage.
    when the parcel was recieved, did you sign for it as goods or box damaged or did you just sign as it was recieved in satisfactory condition.
    if i was you mate i would be on to the courier company as well as the seller mate.

    as for who pays the return shipping i wouldnt really know. if you are wanting to send back the item then i guess you should be liable for the cost. but then again if it had come from a shop in that state then one would expect them to pick up the return costs. i suppose as a good will gesture the seller could reimberse you for the cost of shipping.
